CORVALLIS, Ore. - It has been exactly two years since 19-year-old Brooke Wilberger disappeared from a Corvallis apartment complex.

After literally thousands of hours of official and volunteer searches for the BYU student, family, friends and Benton County authorities would not give up.

But a 39-year-old man was finally arrested in August 2005 and charged with aggravated murder, kidnapping, rape and sodomy of Wilberger.

Her body has never been found.

Joel Courtney is awaiting trial in New Mexico on unrelated kidnapping and rape charges involving a college student there.

Brooke's family just recently filed a lawsuit against a company that employed Courtney.

They allege Creative Building Maintenance failed to complete a background check when they hired him.

They say that allowed an unsupervised Courtney to use a company vehicle and allowed him to commit crimes.

The human remains found by loggers near Lincoln City Sept. 14, were not Brooke Wilberger. The announcement was made Tuesday following an analysis by the state medical examiner's office, and puts an end to speculation the missing student who disappeared from a Corvallis apartment might finally have been found.

The remains were those of a younger man, according to Sgt. Ralph Turre of the Lincoln County Sheriff's Office. An examination by Deputy State Medical Examiner Larry Lewman, as well as items found at the scene, led him to determine the cause of death was likely hanging. No foul play is suspected.

Loggers found the skull and other bones in a heavily wooded area about a quarter of a mile from any road, while clear-cutting.

ALBUQUERQUE, N.M. - The man accused of murdering Brooke Wilberger in Oregon has been found competent to stand trial in a separate rape case in New Mexico.

Joel Patrick Courtney is accused of raping a foreign exchange student at the University of New Mexico. During a competency hearing, Courtney's lawyer argued that he cannot defend his client because Courtney refuses to talk to him. The prosecutor argued that he is competent, but manipulative. The judge set a mid-May trial date.

Courtney was arrested in 2004 in Albuquerque after being accused of kidnapping and sexually assaulting the student. Eight months later, in July of 2005, Courtney was indicted in the Wilberger case. He faces Oregon charges of aggravated murder, kidnapping, rape and sodomy.

Brooke Wilberger disappeared from Corvallis in May 2004. She was 19 years old at the time. Her body has never been found.

Brooke Wilberger Update: Murder Suspect Pleads Guilty to Unrelated Rape Case, Setting the Stage for the Murder Trial (Bill Bickel's Crimeweek, September 11, 2007)

Today, in what would have been the first day of his trial for the abduction and rape of a University of New Mexico student (jury selection began and was completed yesterday), Joel Patrick Courtney pleaded guilty to single charges of criminal sexual penetration and kidnapping, for which he can be sentenced to up to 18 years in prison. Following his sentencing, which will come after a 60-day evaluation period ordered by the judge, Courtney will be extradited to Oregon to stand trial on 19 counts of aggravated murder, kidnapping, rape and sodomy stemming from the May 24, 2004, disappearance of 19-year-old Brooke Wilberger.


Personally, I can't imagine what the defense gains by this plea: All this does is expedite the Wilberger trial, for which capital punishment is a strong possibility. Courtney really had little or nothing to lose by going ahead with the New Mexico trial and the longer he could postpone the Oregon trial -- with the possibility of evidence being lost, witnesses disappearing or their memories fading, the case fading somewhat from the public consciousness -- the better his chances would be.

CORVALLIS, Ore. Five years after college student Brooke Wilberger disappeared, a man has pleaded guilty to her murder and directed police to her remains.

The developments ended one of the most publicized murder investigations in Oregon history and put away a man who also was convicted of raping another student in New Mexico.

Benton County District Attorney John Haroldson made the surprise announcement today.

The Brigham Young University student vanished in May 2004 from an apartment building in Corvallis.

Defendant Joel Courtney avoided a possible death sentence by pleading guilty to aggravated murder and revealing the location of Wilberger's remains.

Courtney was sentenced to life in prison without the possibility of parole after entering the plea in Marion County Circuit Court in Salem.

Brooke Wilberger's mother today said she was grateful to Joel Courtney, the man who pleaded guilty to murdering the Brigham Young University student, for finally telling authorities where to find the young woman's remains.

Cammy Wilberger, visibly moved as she spoke at a news conference in Corvalis, Ore., said that after five years of not knowing where her daughter was, "We just want to strengthen our family and go on with our life."

Benton County authorities for the first time described what happened to Wilberger, who vanished from an Oregon apartment complex May 24, 2004.

Courtney said he abducted the blond 19-year-old college student at knife point, bound her in duct tape in his van, drove her into the woods, kept her overnight and then raped and bludgeoned her to death, Benton County District Attorney John Haroldson said.
