Kristin Denise Smart disappeared from Cal Poly Campus on May 25, 1996 and has not been seen or heard from since. Kristin was last seen walking home from an off campus party in the company of another student, Paul Flores. Mr. Flores refuses to answer any questions.
Kristin was 19 years old at the time of her disappearance.

xx Update to the K. Smart Case 10-15-04

To make this sound like it should I'm just gonna paste the content from Dennis' site. Dennis, Denise and Stan... we all are supporting you 100%.

Website

The Flores are once again attempting to have this site shut down. No surprise there. Two years ago, when this happened, I literally drove to the offices of Homestead and met with their attorney. Once I explained our side of the issue, the site was allowed to remain. This time things are a bit different and the reason I was given is that this case is so old that a person's 'right of privacy' outweighs the public's right to know.
I obviously do not agree with this - but in fairness to Homestead, they have always been terrific to me and in my heart I believe they are trying to work with me.
I have extremely skilled professionals in the legal and web hosting fields working very closely with Kristin's family and myself to resolve this matter. Things may slightly change here in the near future - but one thing needs to remain perfectly clear:
This website is going nowhere until the Flores cooperate with the San Luis Obispo Sheriff's department. That means answering all the questions the Sheriff's office need to ask, and answering those questions to the complete satisfaction of the Sheriff's office. Once that happens - then I will take this site down.

There are other website hosting companies available to me that SPECIALIZE in hosting websites just like mine who have their own strong feelings about free speech.

Additionally - law firms and Internet 'free speech' associations have expressed their desire to help us in any way. So, if anything, this has the potential of really drawing tremendous publicity. Good for Kristin.

Civil Court Case

I am not a lawyer so I am going to explain this to you as a common man.
The Smart's initiated a Wrongful Death civil suit against Paul Flores for the death of their daughter. The Smart's attorney (James Murphy of Arroyo Grande, Ca) needs to present his case to a judge who will then determine if the case has enough merit to proceed. Murphy asked the San Luis Obispo Sheriff's office to have a look at their files to help strenghten the civil case.
The Sheriff said 'no' which is hard to swallow. Their reasoning is that they need to protect the criminal case they are building and have Paul Flores as their suspect 'numero uno'.
This issue of whether the Sheriff must comply with the Smart's atty and allow them access to the criminal files went before the judge about 3 or 4 months ago. During that court hearing it came out that the Sheriff's office was spending 2-3 hours per month on Kristin's case. The judge was not amused.
He ordered a new hearing for Oct 20th and said that the Sheriff's office had till then to prove that they are working the case and need to really not divulge their work - even to the Smart's attorney.
So - as you can imagine, this past Wednesday was shapining up to be a big day for Kristin's family.

Guess what! The case got delayed again! This time until November 9th. The reason being is that the judge went on vacation and I am not even going to make a comment on that piece of information.

We've all read Robert Frost's poem 'The Road Not Taken' at some point in our lives. It just seems appropriate now. We can let the status quo take over or we can take that other road and do something that will make 'all the difference'.

ALright, I just got off the phone with Dennis. He says they will know for sure on November 9th if the Smarts can take this case against the Flores to civil court. There is another project that isnt available for public disclosure yet that was in the works but now has been put on the back burner until this civil suit decision can be determined. Dennis just keep pushing on.

Looks like a new person has come forward saying that they too had a run in with Paul Flores. The website is back up but under a new server. Gotta hate this for the Flores group. They were unsuccessful in taking down the inflamatory material that shows they are killers.

xx Judge makes ruling in Kristin Smart case

The investigation continues into the disappearance of Kristin Smart, who was last seen on the Cal Poly campus eight years ago.

On Tuesday, Smart family attorney Tana Coates appeared before Judge Roger Picquet, requesting the San Luis Obispo County Sheriff's Office release information concerning its investigation into Smart's 1996 disappearance. Coates says family wants the information to pursue litigation filed against Paul Flores-- the last person seen with Smart.

"We wanted these records so that we could oppose a summary judgement motion that had been filed by the Flores defense team," says Coates. "And without those records, we felt that we would have a difficult time opposing that motion."

After hearing sworn testimony, Judge Picquet ruled not to disclose the records, saying he had good cause to believe the sheriff's department is still actively investigating, and that the case could end in the near future.

"The court is encouraged that this investigation has not grown cold, we're also encouraged by that," says Coates. "But by the same token, it's been quite a few years now and if it's just a back burner investigation, then we do need those records."

Kristin Smart's mother, Denise Smart, says she wants to believe authorities are actively investigating her daughter's disappearance, and that the most important thing to the family is bringing Kristin home, not their lawsuit against Flores.

The Flores family was in court as well on Tuesday and declined to comment. A follow up hearing is scheduled for July 1, 2005.

A judge Tuesday denied the family of missing Cal Poly student Kristin Smart the documents the county Sheriff's Department says it still needs for its continuing investigation.

Judge Roger Piquet said he'll consider the family's request again in July.

Stan and Denise Smart also unsuccessfully tried to get the documents for a wrongful death suit against Paul Flores in October 2003.

Flores was the last person seen with their 19-year-old freshman daughter Kristin Smart when she disappeared after a Memorial Weekend party in 1996.

The family filed the wrongful death suit in May 2002. Flores, a Cal Poly student in 1996, was questioned by authorities but never arrested. His family lives in Arroyo Grande.

The Smarts' attorney, Jim Murphy of Arroyo Grande, said the judge's decision Tuesday helps confirm that Flores is still a suspect in the case because it allows the wrongful death suit to continue. Flores' family has tried to have the suit dismissed.

The ruling "shows there's an ongoing investigation into Kristin's disappearance and death," Murphy said. "As long as the Sheriff's Department is actively pursuing the case, it doesn't have to turn over the documents. And, we can't bring Flores to (civil) trial without access to those documents.

"Our goal is to keep Paul Flores an active defendant in a wrongful death lawsuit, and the judge's decision keeps our goal alive."

Sheriff's spokesmen say the Smart investigation is still a priority. Several searches for Kristin Smart's body -- under the auspices of the Sheriff's Department and FBI -- have been conducted since her disappearance.

Numerous newspaper and national magazine articles along with TV segments have told of the Smart family's heartbreak and frustration through the years.

Sheriff Pat Hedges has called the case "probably the longest running active one we've ever had. We have a commitment to this case."

xx The Two Kristins Featured on The Globe

I just received a phone call from Dennis that Kristin Smart and Kristin Modaferri are in the GLOBE magazine. They are showing that Scott Peterson is related to the disappearances of the two Kristins, but we all know that is false information. The Smarts and the Modaferri's are not angry about this, but they are glad their girls are in mass production on the magazines cover.

I am told the March is probably going to be in March of 2005. I will keep you all updated.

My dear friend and helper of the Smart family is planning the 1,000 mile March for Kristin Smart. There is a petition if you are unable to fly to San Luis Obispo to support this event. Please consider signing this if you have not already. We must get the yard dug up because it is believed that Kristin's remains are buried there. Do a good deed today and please go sign this petition.

A suggestion which would possibly be very helpful in finding Kristin would be composing downloadeable posters of Kristin with captions such as 'We Remember Kristin', 'We miss you Kristin' with her beautiful picture(s) of course and hanging them up around not only the Flores property, but all over far and wide wherever there are hearts to be touched. Carrie and others should also be rembered with our 'Paper Angels'* initiative.
Not only missing persons, but all murder victims should be remembered in this manner and let no cynical predator ever dare say or suggest 'no one will miss this person'. Laying flowers is nice, but you can't fight for justice that way.

The Song played at Dru Sjodin's funeral services referring to the posters of the missing.

Your idea sounds great to me. Dennis Mahon has been found many nights parked in the Flores front yard writing the book about Kristin. They have billboards up in that town everywhere. They even tried a restraining order against my dear friend for his pushing the topic so much. LOL
Dennis is more in your face than I am, if you can believe that one. shocked I'll ask him about these flier. Consider coming to San Luis with us in March. I'll post the date as soon as it is known. As of last week, Dennis is still planning this. Nothing is written in stone. We will have information soon.

Dennis Mahon instructed me to post the following message tonight as he was in route to San Luis Obispo for the upcoming March for Kristin. He will begin his walk in a few weeks once he arrives in California. Our group here at FindCarrieCulberson.Com will be part of this event once he completes the march. He has asked me to post daily the events and material for him.

I look forward to flying into San Louis Obispo to help with this cause. This is very very important. We will be rallying outside with hopefully thousands of others who feel this event must happen. All of you are asked to join in to support finding Kristin.

Talked to Dennis about 20 mins. ago. He is still driving towards CA. He wanted to me let everyone know that once he arrives in San Luis Obispo and begins his walking, there will be photos and a live feed each day.

I will be watching this thing CLOSE because I support Dennis 100% and I'M READY TO HOP THE JET TO CA.

Dennis is still traveling. He is making one stop before CA. There will be a 14 day black out period here because they are preparing for this walk and then he will head directly to CA. Right now he is working with someone to complete the final touches. I'll post anything significant and once the walk starts, we will be helping with keep people up to date with the live feeds and photos.
