April 18th, 2005 Grand Jury
I began the day as I usually do by taking the banner over near the Arroyo Grande Community school so that Susan can be reminded of the truth that she needs to face. I was there at about 7:20am and stayed til after school began.


I then made may way north to San Luis Obispo and turned in all the required paperwork to the Grand Jury and now for us it is a waiting game.

As you may be aware, the Grand Jury operates under strict secrecy in that I was given no timeline for when a response would be given. I do not even know where they meet. Nonetheless - I was very thorough and included anything and everything I thought would be helpful to Kristin's cause. So - stand by on this one and I will let you know.

Cal Poly ReMEmber Week Runs April 22-29 With Events Open to the Public

SAN LUIS OBISPO -- “ReMEmber Week,” a week of events devoted to raising awareness about sexual assault and violence towards women, will be held on the Cal Poly campus and at locations throughout the community April 22-29.

Most events are free and all are open to the public. Events include self-defense classes, speakers, yoga and dance classes. The week ends with the annual “Take Back the Night Rally.”

Events Scheduled during ReMEmber Week 2005 include:

Friday, April 22: Memorial, 5 p.m., Mission Plaza, San Luis Obispo.
A night to remember victims of violence Kristen Smart, Rachel Newhouse, Aundria Crawford, Christina Hogan, and Laci Peterson, as well as other survivors and victims of sexual assault.

Saturday, April 23: “Walk a Mile in Her Shoes,” noon, Mitchell Park, San Luis Obispo.
A chance for men to slip on stilettos for a one-mile walk through downtown SLO to raise awareness about the role men can play in ending sexual violence. Shoes will be provided, but are not required. Activities include BBQ and music. Registration at 11:30 am. Call the SARP Center for details contact (805) 545-8888.

Sunday, April 24: Yoga, 3-4:30 p.m., Mitchell Park.
Evening yoga will focus on alignment and relaxation by releasing tension in the joints. Instruction will be provided on how to soothe the mind and create balance and inner calm. Wear comfortable clothing. Limited mats. Donation suggested.

Monday, April 25: “Run 2 Remember,” 6 p.m., Cal Poly Health Center Lawn.
Come and enjoy a timed 5K fun run under the stars on Cal Poly's campus, while raising money for Remember Week. Open to everyone. $15 Registration fee includes a t-shirt and a glow stick bracelet. Pre-register at the Women's Center, UU, Room 217 or register the night of the run on the Health Center lawn.

Tuesday, April 26: UU Hour Debate, 11 a.m.-noon, University Union Plaza.
Come listen to a debate with the Cal Poly Debate Team in the UU Plaza. The topic of the debate will cover a relevant issue of sexual assault. Judges will oversee and present a $100 prize to the winner

Self-Defense Workshop (for women only) 5-9 p.m., University Union, San Luis Lounge.
A four-hour training put on by the SARP Center teaching assertiveness, awareness, and self-defense techniques. Wear comfortable clothes. Space is limited; sign up early by calling the Women’s Center at 756-2600.

Wednesday, April 27: Nia Body Movement, noon-1:30 p.m., UU, Room 220.
A workout blend of martial, healing, and dance arts performed to world music. Wear comfortable clothes. $5 donation suggested.

Transgender speaker Kate Bornstein,T 6-7:30 p.m., UU, Bishop's Lounge.
Kate Bornstein is an internationally known transgender author and activist. Her works include “Gender Outlaw” and “My Gender Workbook.” Her discussion will touch on the politics of sexuality and gender, the complex continuum of personal identity, and the intersection of violence and misogyny.

Thursday, April 28, Women’s Day in the Plaza, 11 a.m.-Noon, UU Plaza.
A day for women to come together and enjoy UU hour with a band, food, informational booths, massage stations, self-defense display, arts and crafts, and games. Sponsored by ASI.

Friday, April 29, Take Back the Night, 5-8 p.m., Mission Plaza.
Enjoy a night of entertainment, education, awareness, and empowerment. The night will include music by Mudbath drum circle, nationally-known spoken word artists, food, and interactive art activities.

I just received this email from Dennis this morning. He is on his way to court, and the support he is getting from the AG Community is still going strong.

Greetings -

I am on my way to court.

I guy on the street gave me a great idea last night. I am going to try and put "Dig Up Susan Flores Backyard' on the elctoral ballot here in AG. I was told by the Libertarian Party that about 800 signatures would be needed and then a special election will be hold.

The local commuynity would really support this!

Gotta run to cort.

Dennis asked me to post this message in his abscence because he has to work this afternoon.
He wanted me to let you all know that today's court date was a positive outcome. He goes on to state that Okorie was wonderful today as always. We could not ask for a better attorney as far as determination and dedication goes.

April 21st, 2005 Farmers Market
Farmers Market in San Luis Obispo is a very big and successful event. each Thursday - a section of downtown is closed off to traffic and a throng of local residents and tourist take over and enjoy the many vendors that set up tents and displays.


It always draws a huge crowd so naturally that is where I spent part of my day. On this particular day- two pretty interesting things happened. First, I was approached by a man who suggested that I should have our desire to 'Dig Up Susan Flores' yard be placed on the ballot and let voters decide if they want their tax dollars to be used for such an endeavor.


I had never thought of that and it sounds like a great idea. I spoke to the men overseeing the Libertarian and Democratic party tents at the Farmer's Market and they both told me to go through city hall to get the process started. So, the following day I went to the city offices and to inquire how to get that done. The person I needed to speak with was out for the day so I will need to wait til Monday to get that ball rolling.
Secondly - I was approached by a bunch of kids who enthusiastically told me that they used to attend the AG community school and that they all hated Susan Flores. THey told me they would tease her all the time about her son and what he did. The kids told me that Susan would always say that Paul was a good guy and that she wasn't able to talk about the case. She did say that was was such a good guy that he joined the Army. What she failed to tell them was that the service refused to take Paul after learning what he has been accused of. Maybe she forgot that part.


I asked the kids if I could have their photo for this website and all agreed. I know that photo quality is poor - but, it is what it is and so I am sorry about that.


In any case, after the photo was taken, one of the boys said to me, "Oh now...now I feel bad." I asked him why and he said, "Coz Susan always used to watch my back. She'd watch my back." I asked him what he meant by that and he responded, "Dennis, you see, I used to smoke pot and she would catch me but she would never rat me out!"

April 22nd, 2005 Court with Flores/McConville
I was in court today over 3 matters. 1st. The case against me for violating the restraining order. 2nd) My case against Flores/McConville to have the restrained from coming near me and 3) My lawsuit against Miuke McConville for Malicious Prosecution when he had me arrested two weeks ago at the City Council meeting.


Flores vs. Mahon: Restraining Order Violation
A couple years ago the Flores/McConville crowd successfully convinced a judge to issue a 3 yr restraining order against me which mandated at stay at least 50yrds away from their residence, their employment and their vehicles. I disagree with the judge but am smart enough to know that what the judge says...goes. Fortunately - with the media and this website - I can still do right by Kristin and not violate the order.


In November of 2002, Cancer struck my family back East and I dropped everything immediately and went strait home. While I was back in NC for over 6 months - I was served with papers saying I violated the order and I needed to be in court. I did not make it to court because of the logistics and money issues and a warrant was issued for my arrest. I did file papers with the court but they reached the court house one day late. That is all true --thus - the warrant.


Upon returning to California, I was arrested for that warrant and was released from jail two days later on my own recognizance. The Flores wanted me sentenced for this, however, Okorie Okoracha, my fine atty successfully argued his legal points to the Judge and the judge decided in the end to set a new trial date for May 13th.


The Flores did not want the date any later than that because they pointed out to the judge that my rally was the 14th and that I would skip town right after that. The judge settled on the 13th at 10:00am so stay tuned for that.



Unbelievable
The truth is, all this nonsense can make you pretty jaded, but today, Jeff Radding, the Flores atty really stunned me. After both atty's argued their legal points, Judge Picquet, asked both men to sum up in one sentence why the court should or should not allow me a full hearing on these charges.


It was Radding's turn to go first and he thought for a second and then said, "Because, your Honor, Justice delayed is justice denied."


Keep in mind that Kristin Smart has been maliciously buried in some horrible grave unknown to her family for almost 9 years. The people that Radding represents and collects his 30 pieces of silver from are the prime suspects in Kristin's disappearance. (Paul Flores).


Justice delayed is justice denied. This shows you just how horrible some people can be.


Mahon vs. Flores/McConville
I was hoping to have my case regarding keeping the Flores away from me heard today. However, the judge decided to put it on the May 13th calendar to coincide with the other case. So - I need to wait until then to see what happens.


Mike McConville Lawsuit

Okorie Okorocha, my atty, served Mike McConville with papers in the courtroom today serving him notice that he is being sued by me for Malicious Prosecution for having me falsely arrested on April 12th. McConville drove to where I was (city council meeting) and then called the cops saying I violated the restraining order by saying I was within 50 yards of him.

I was hauled off to jail by Arroyo Grande Police Officer Vince Johnson and spent two night in jail. The DA refused to take the case and I was released without posting bail or having to see a judge.

I will let you know when this case goes to court.

Ok. I blew it. The photo of Susan Flores is screwed up because I had the camera aimed to low. Such is life. In any case - I attended the Arroyo Grande City Council meeting this evening and this time I was not arrested. It was at this same exact location two weeks ago where Arroyo Grande Police Officer Vince Johnson arrested me for violating the restraining order the Flores/McConville family has out against me. The DA refused to hear the case and now I have a lawsuit out against McConville for malicious prosecution.


The Flores claim I have violated the Restraining Order and I have a trial to answer those charges on May 13th. My attorney, Okorie Okorocha, has asked me to let my readers know that he will call Ruben Flores, Susan Flores and Mike McConville to the stand.


Okorie is one of those truly great lawyers in this country. He provides his services free to myself and the Smarts and takes it upon himself to represent me even though his office is 3 hours south in Pasadena, Ca.


He has chosen to represent, ultimately, a young woman who has been horribly wronged and whose life has been reduced to a candy wrapper by the Flores . He does it all for free. The man is legit. If the Flores are so innocent - then they should cooperate with LE.


The photo in the middle is pretty interesting because it demonstrates just how much the Flores could care less about what the local community thinks of them. That is McConville's car parked right in front of a billboard for Kristin which has been displayed on Attorney Jim Murphy's front lawn for about 8 years now.


The Attorney's office is next door to the city council.


During the meeting where the public is allowed to speak, I was the first speaker and I was followed by Susan Flores herself.


I addressed the Mayor and city council and then turned sideways to direct my initial comments to the 50 or so people who were in attendance.


I basically said that I thought it was important to at least let the powers-that-be in Arroyo Grande hear the name of Kristin-Denise-Smart spoken in this chamber and that we are going on 9 years and it has been way too long. I also mentioned aloud that the Flores/McConville crowd were in attendance and that I have had my standing offer on the table for years (Cooperate with the San Luis Obispo Sheriff's department and I will shut the website down the same day.) and that they have never taken me up on it.


I also mention the June 2000 Search Warrant where a vote was taken whether or not the Flores backyard should be dug up and that the Law Enforcement ballot tally was to 'not' dig up the yard. I simply said that I thought Kristin deserved to have the yard dug up.


Susan then followed and began her comments by thanking the Arroyo Grande Police department for their fine work in Arroyo Grande and that she also hopes that Stan and Denise find their daughter and are able to return Kristin to her family.


She mention that City Hall has on file documents saying that the concrete that was poured in her backyard date back years before Kristin vanished. I think she said 1981 and that I am on a mission to harass her in this town and at her job.


She was very calm and pretty much was reading a prepared statement.


I then hung around for about 45 minutes and got up to leave around 8:00pm. My banner was being stored in a separate conference room permitted by the Arroyo Grande Chief of Police. When I went to retrieve the banner - the Police Chief and three other men were just sitting around the conference table looking like they were just casually talking.


Friends among friends.


One of those three men was Mike McConville so while I admit that it looked strange - I just didn't feel that the Chief of Police ought to be hanging out with the likes of McConville unless it was in an official capacity (interrogation) because I think Kristin deserves that much.


Still - it is very possible that I read the entire scene totally wrong so that needs to be said as well. Maybe there was a very logical and valid reason for the AG Police Chief to be hanging out with one of the key players in the case of Kristin's disappearance.


McConville certainly has nothing to do with Kristin's disappearance. That it not what I am implying. He does, however, have incredible access to all they key people and I believe with all my heart that a) He has information that investigators would dearly love to know and that b) he clearly made a decision years ago that he was not going to help the Smarts find their daughter.


On a much more positive note - initial discussions began today with a silent investor who has come forward with the assets necessary to make a public offering to purchase the Flores residence.


I spoke with Denise Smart this evening and she will be spending tomorrow talking to the correct professionals to see what steps are necessary to make this happen properly.

As usual, the San Luis Obispo Farmers Market was jammed packed. I'd guess about 3,000 people - or more - were in attendance and I am positive that 100% of them saw the banner.

The most interesting exchange of the day took place when a young man approached me and gave me the name of a friend of his who had an interesting story to tell me about the Cal Poly Police in relation to Kristin Smarts case. The source wanted to remain anonymous and then proceeded to share with me a story that I knew to be true because I had learned of it elsewhere years ago and had it verified.


Essentially - a student at Cal Poly found a bunch of files on Kristin's case which were thrown away by the Cal Poly police.


Important! Cal Poly police is not the same as the San Luis Obispo Sheriff's office. As a matter of fact, the SLO Sheriff's dept came in and took the case away from Cal Poly police because they badly mishandled Kristin's abduction.


Here is the story:


A maintenance man at Cal Poly retrieved a filing cabinet from the disposable furniture yard at Cal Poly. It was explained to me that every few years or so, Cal Poly gets rid of old furniture and replaces it with newer stuff. Before the old furniture gets set out to pasture, they allow employees to go though and take what they want. Mark, the maintence person, liked the filing cabinet and took it home with him.


The only problem though was that the cabinet was locked and there was no key to be found. Mark, who was living with his girlfriend at the time, basically used the cabinet as a 'lamp stand' and really thought nothing of it for the next two years.


Mark and his girlfriend split up and the day came for them to separate the furniture. While Mark was going through his stuff - he decided to pry the cabinet open and that is when he found all the files on Kristin.


Mark knew Smart Atty James Murphy and he turned the files over to him. Attorney Murphy then placed a call over to SLO Sheriff and arranged to get the files back into proper hands.


That is a true story!

Both Susan Flores and I attended the most recent City Council meeting and spoke about Kristin Smart. Believe it or not - Susan Flores said it was her wish that Kristin be found soon and returned to her family. All the while she and her family refuse to cooperate with investigators trying to find her. I am having both of our comments digitized and will post them here online so you can see for yourself Susan 'in her own words'. It is possible I will have this on this website by this time tomorrow evening.


I also received an email today from a reporter from the San Luis Obispo Telegraph and Tribune who wrote to let me know that he submitted a book propasal to one of the leading book publishers in New York and they have thus far agreed to take a closer look. He did tell me that this first step is really a 'baby step' so not to consider it a done deal by any means. So - as this progresses, I will let you know.

May 4th, 2005 McConville
This morning as I stood at the intersection to the Arroyo Grande Community School with my banner, Mike McConville drove up, parked his car nearby and then used his cellphone. Who knows what he was up to. The Arroyo Grande Police department told me two years ago that standing at that location would not violate the restraining order so I knew I was OK. Anyway - he sat there for about 10 minutes and then the suspects mother, Susan Flores came driving by right at about 8:00am. McConville then drove off. In a few minutes - I am going to hopefully pick up the digitiaed version of the city council meeting and then post it here online so you can see it. Stay tuned!

Susan Flores testifies before a judge who sentences an amateur detective for violating restraining order

Paul Flores' mother testified Friday that her son did not kill Kristin Smart, the Cal Poly student who has been missing since 1996.

Susan Flores' testimony came as a judge ordered an amateur detective to spend 20 days in jail for harassing the Flores family in violation of a restraining order.

Susan Flores said Dennis Mahon has stalked her family -- asking for volunteers to take aerial photos of her home, visiting her workplace and sending out postcards to Paul Flores' neighbors that accused him of involvement in the disappearance of Smart.

Mahon is dedicated to finding Smart, said San Luis Obispo Superior Court Judge Roger Picquet, who presided over the hearing Friday. But by pressuring the Flores family to confess to a crime they've never been charged of, Mahon has "impacted their lives. He's impacted their lives to an extent that is unacceptable," Picquet said.

Susan Flores testified that Mahon arrived at her work with a sign calling her son Paul a killer. And Flores' live-in boyfriend, Michael McConville, said he lost his job because his employer did not want to be associated with the case. Mahon had posted on his Web site the name of McConville's employer.

Mahon operates a Web site, www.sonofsusan.com, that publishes the Floreses' addresses and tracks Paul Flores anytime he moves to a new residence. The site also includes information about Smart's disappearance.

Most of the evidence of harassment came from the Web site.

As an example of how closely Mahon monitored her, Susan Flores told the judge that moments after she removed a political sign from her front yard during a campaign several years ago, the Web site was updated.

"That told me he (Mahon) was really watching us," Susan Flores said.

The site also featured pictures of the home of Flores and McConville. The photos were taken from about 50 yards away, which is as close as Mahon can come to family members or their residences, according to a restraining order issued in 2002.

"He is certainly playing games with the issue" by getting so close, Picquet said.

The Floreses requested the restraining order, saying Mahon was harassing them.

Mahon is not related to Smart, but the North Carolina man volunteered to help with the case after learning about her disappearance.

The 19-year-old was last seen walking home with Paul Flores from a party on the Cal Poly campus on May 25, 1996.

Mahon's tactics are designed to encourage the Floreses to "tell the San Luis Obispo Sheriff's Department everything they know," the Web site says.

Before the judge sentenced Mahon for violating the restraining order, Mahon said he was sorry for upsetting the Flores family.

"I don't do Kristin any good by stepping over any bounds," Mahon said. "I owe the Flores family an apology."

Picquet sentenced Mahon to 40 days in prison, but Mahon will serve 20 days as long as he does not violate the restraining order again. If he does, those 20 days can be added on to a new sentence.

Mahon's attorney, Okorie Okorocha, questioned Susan Flores' objectivity. Mahon's efforts to paint Paul Flores as Smart's killer tainted her ability to be fair, he said.

He asked Susan Flores if she had any bias against Mahon. "Do I like him now?" she said. "No."

"Did your son Paul commit the murder Mr. Mahon is investigating?" Okorocha asked.

"No," Flores said.

"Did your former husband bury a body in your back yard?" Okorocha asked.

"It is not possible," Flores responded.

At the conclusion of the hearing, Mahon was arrested and booked into County Jail to begin serving his term.

The restraining order against Mahon is set to expire this summer. Picquet set a hearing for July to see if the order should be extended at the request of the Floreses.
