xx Search continues for Kristin Smart

For the last nine years, Kristin Smart's family says they've been living a nightmare. While the missing Cal Poly freshman's case is still active with the sheriff's department, her parents say it's more important than ever to keep her story in the community spotlight.

On May 25, 1996, 19-year old Kristin Smart disappeared, and the search for answers continues. Smart was last seen walking to her Cal Poly dorm after a party with Paul Flores, the man currently considered a person of interest in the case.

"We have not lost hope that the case will be solved," says Captain Gary Hoving, of the San Luis Obispo County Sheriff's Department. "So long as new and additional information comes in, we will continue to work on the case."

Smart family friend Dennis Mahon says finding Kristin is his life's goal. The North Carolina native has created a website for the Smart's daughter and continues to post signs around town, in an effort to keep Kristin's story fresh in the public's mind.

"About a month ago, Gerald Shea, the district attorney, personally drove five hours north to meet with the Smart's, and we're encouraged by that," says Mahon.

Currently, the Smart case is active, with one full-time sheriff's detective sifting through leads. About six months ago, a dive team scored a private ranch in San Luis Obispo County, after receiving a credible tip that Smart's body was at the bottom of the lake.

"The location was plausible, so we assembled a dive team and we searched the entire bottom of that lake, and we did not find any evidence in the case," says Hoving.

In a prepared statement, Kristin's mother, Denise Smart, tells Action News:

"We have had to face something even worse than losing a child; it's coming to terms with the fact that our Kristin is not actually lost! There is someone who knows where she is...This was a girl who believed in tomorrow. We can do nothing less for her. We must also believe in tomorrow, meet the challenge, and do whatever it takes to bring her home. She would have done nothing less for us."

The San Luis Obispo County Sheriff's Department says they receive dozens of tips nearly every week in the Smart case, and are currently pursuing what they believe is a strong lead at the moment. If you have any information that can help detectives, you're asked to call the sheriff's department immediately.

xx Judge: Son of Susan Website STAYS

Today the judge presiding over the Flores case against Dennis Mahon and the Smart Family's website www.SonOfSusan.Com ruled that the site WILL remain in place. Part of the law suit filed by the only suspect's family stated that the website Son of Susan needed to be removed because it pointed out things they wish not to be made known by the citizens of San Luis Obispo California.

The search is ongoing for Kristin Smart and they will continue until she is located and Paul Flores is indicted. This was a victory for those of us today who have been waiting patiently for justice to prevail for the Smart family. This is a step in the right direction.

This one for the good guys tonight.

xx Court ruling in Kristin Smart case

By: Wendy Thies

Nine years after her disappearance, a judge rules in the Kristin Smart case, giving her family new hope that someday they may find her.

Cal Poly freshman Kristin Smart attended a party off-campus in May 1996, and never made it back to her dorm room. To this day, investigators have not ruled out Paul Flores as a "person of interest." He was the last one seen with Smart that night. Smart has not been found, however San Luis Obispo County Sheriff Pat Hedges says an investigator is working full time, trying to crack the case.

"It's certainly our hope," says Hedges. "I can't say when but I remain optimistic that we'll e able to prosecute the individual responsible."

On Wednesday, the San Luis Obispo County Sheriff's Department went to court, convincing Judge Rodger Picquet that they are making progress and their records should stay confidential, instead of giving them to the Smart family for a civil suit against Flores.

"I'm just pleased that the judge recognizes that we do have an active investigation and that we'll be able to continue with that case," says Hedges.

Flores' mother, Susan Flores came to court for her son, and Smart's mother, Denise Smart, traveled from the Bay Area to attend the hearing and talk with the sheriff's department.

"Meeting with them was helpful in the fact that it was reinforced to us that progress is being made and that leads are being followed up and it's far a dead end," says Denise Smart. "Whenever you hear it first-hand it kind of renews your hope that it's not over."

Mrs. Smart says her daughter is loved and missed and needs a Christian burial, adding that time doesn't heal all wounds.

"When your child is kidnapped and stolen from you, the pain never goes away," says Smart.

The sheriff's department will return to court in November to show the judge their progress on the investigation. The Flores family declined to comment on the case.

Kristin Smart Disappearance

Flores family sues Smarts and their friend

By Cynthia Neff

The Tribune

Susan Flores and boyfriend Mike McConville have suffered severe emotional distress and lost income because of Dennis Mahon's investigations into the disappearance of former Cal Poly student Kristin Smart, court documents filed this week claim.

The complaint, filed Tuesday in San Luis Obispo County Superior Court, asks for punitive damages. It states the actions taken by Smart's parents, Denise and Stan Smart, and Dennis Mahon, a family friend, "were undertaken with malice, fraud, and oppression" and with intent to harm.

Kristin Smart, a 19-year-old freshman, disappeared after a Memorial Day weekend party in 1996. Susan Flores' son, Paul, was the last person seen with Smart.

Mahon operates a Web site, www.sonofsusan.com, that publishes the Floreses' addresses and tracks Paul Flores any time he moves to a new residence. The site also includes information about Smart's disappearance.

In May, Mahon was sentenced to 40 days in jail for harassing the Flores family in violation of a restraining order they have against him.

Mahon's attorney, Okorie Okorocha, called the complaint filed this week "the height of frivolous."

"This is just to harass the Smarts," he said.

Okorocha did confirm a few points in the complaint, including that Mahon had organized and promoted a rally for 3,000 people with shovels to dig up Susan Flores' back yard in Arroyo Grande.

Jeffry Radding, McConville and Flores' attorney, declined comment Thursday.

xx Leave a Voice Mail for Kristin

Son of Susan now has a feature on their website where you can leave a voice mail for the family with your thoughts on the case as well as well wishes. It does not cost you anything to leave the message, so please feel free to call in.
We dont know how long this will be up and running because of the Flores. I cannot guarantee you that there wont be some messages that dont contain profanity and anger towards the Flores.
You can hear all of them by clicking this link below. This is a new feature to help keep the interest level up and possibly get some answers SOON for Kristin's case. GIve this thing a shot, its FUN to listen to.

Directly from Son Of Susan Website:

No guarantees, but Greta Van Susteren has responded to 'Sam the Super Cop's' email request that she take a closer look at Kristin Smart's case. Greta is aware of Kristin's case because a member of her staff contacted the Smarts a few years ago but no coverage ever developed from it. Perhaps Kristin will have better luck this time. There are some pretty interesting similarities between Natalie Holloway and Kristin Smart.

1 Both girls were young, blonde and beautiful.
2 Natalie and Kristin both vanished after a night of partying and running into a young teenager with a history of violence against women. See Paul's past here.
3 Police have a very solid suspect in both cases. Paul Flores and Joran Van der Sloot
4 Neither suspect is cooperating with police
5 The father in both cases is strongly advising his son not to answer any questions
6 Law Enforcement in both cases suspect the father had a hand in the disposal of the body.
7 Joran Van der Sloot was let out of jail and headed straight for Holland. Paul's sister moved to Holland and Paul left the USA and spent time with her there, though he is back in the US now, I believe.

xx Citizen Takes Stand for Kristin

San Diego citizen takes it upon
herself to stand up for Kristin.
"Tammy', from California, took it upon herself to print up flyers in an effort to keep Kristin's story alive. I am not allowed to ask anyone to perform these acts of human decency because of the restraining order so it is refreshing to see people in the public who decide that 'enough is enough'. Some people think that just because Kristin vanished so long ago, then that must mean her tragdey is somehow no longer as important. That is such nonsense and Tammy obviously understands that.

From Kristin Smart Supporter

The billboard I put up on Hwy 101 with Kristin's picture and website on it has been stolen, presumably by those also responsible for her disappearance. The owner of the property has searched the entire three acres and it is simply gone from behind a chain link fence.

This billboard was the only link to www.bringkristinhome.com that exists on a main freeway and we need another one up.

I paid for the last one and I cannot do it alone this time. Real estate has been good to us all, I am asking you guys to dig deep and make a donation to Kristin's billboard fund at midstate bank. You can print a deposit slip from the above referenced website.

A hundred bucks from each of us will enable us to erect another billboard TOO BIG FOR THOSE BASTARDS TO STEAL. Help us. Make a donation to the Kristin Smart billboard fund at Mid State Bank.

Obbiously SOMEBODY didn't want any more leads to come in off that billboard.

xx New reward offered for Kristin Smart

BY KING HARRIS

Terry Black is an angry man. So angry, in fact, he’s willing to part with $25,000 of his own money as a reward to anyone who finds Kristin Smart. “There is enough information out there to solve this case right now if somebody gets out there and does this,” Black says. “I’m mad. I have a 25-year-old daughter myself.”

The case to which Black refers is no secret to anyone who has lived in SLO County during the past ten years. It involves the disappearance of Kristin Smart, a 19-year-old Cal Poly freshman who vanished in the early-morning hours of May 25, 1996, and hasn’t been seen since. Although it’s never been proven, most people think she was a victim of foul play, that she was either murdered or accidentally killed, and then buried. Numerous investigations by local police, the sheriff’s department, and the FBI have failed to locate her, nor have they led to the arrest of any suspects — although Paul Flores, who met Kristin at a party the night she disappeared and was the last person to see her alive, was once viewed with suspicion by investigators.

Despite nationwide media attention, an infamous Web site devoted to the case (sonofsusan.com), and a $75,000 reward, the mystery continues. Black doesn’t care who’s responsible — he just wants closure for the Smart family. “I’m just looking for this kid’s body,” he says. “I want information leading to the whereabouts of Kristin Smart, and I believe $25,000 will jog some memories.”

Black says he was shocked into the case 18 months ago, when his younger brother Byron, while working at a gas station in Pismo Beach, told him he’d overheard an account by a co-worker of how Kristin was killed. According to Black, when he contacted local authorities with the information, he was stonewalled. Then last fall when he heard the Flores family is suing the Smarts for distress, it added fuel to his fire. “They end up with a dead daughter, missing, the police can’t find her, and now they’re being sued for harassment,” Black says. “When I found that out, I went ballistic. I will remain ballistic until this matter is dealt with.”

Denise Smart, Kristin’s mother, says she always appreciates the help of others in pursuit of the truth, but it’s difficult. “I’m beyond delighted because over the years many, many people have come along and say they’re going to help. They mean well, but they never do it,” she says. “It’s hard going up and down all the time, but Terry is backing up his words, so were really excited about it.”

Dennis Mahon, whose controversial Web site about the Smart case has also been the object of several lawsuits over the past seven years, hopes Black’s efforts provide some answers: “I think he means what he says.”

There’s no doubt Black has the means. He owns an exclusive estate used as a private club and spa called Grand Island Mansion in the delta not far from Sacramento. He also negotiates land issues between Native Americans and the government. But there’s no negotiating with the Smart case. “I’m tired of hearing about this story,” he complains, “and am tired that the community of a bunch of wealthy retired people and a bunch of bright college students can’t put two and two together and come up with the location of a body hidden by a drunk and a bunch of slobbering crankhead gas station attendants.”

Black is paying $1,200 for a full-page newspaper ad in New Times announcing his offer. It is scheduled to run next week.
“I am not pointing fingers in this ad,” he explains. “I’m only interested in generating a sense of public outrage, or at least conscience, about a crime that I think is a blight on your community for not having been solved.”

Kristin Smart was legally declared dead in May 2002, but the case is still open. Denise and her father, Stan Smart, have renewed their wrongful death suit against the Flores family. Denise tells New Times she is frustrated by the lack of cooperation on the part of the sheriff’s department: “We’d like them to call us once in awhile and let us know what’s new… no matter if there is, or isn’t. It’s hurtful to think she’s been forgotten.”
Terry Black hopes to shed some new light. “Somebody knows something,” he asserts. “So I’m gonna do what I have to do, and my first thing is to remind people this is the tenth anniversary of Kristin’s disappearance, and no progress has been made. Paul Flores is talking all the time. I’m expecting $25,000 of my dollars to generate somebody he’s been talking to [to come forward] with some detail.” ∆
